Once proud to represent her county, Paula Lombardi is petitioning the Delaware County District Attorney Jack Whelan to comply with the law and investigate the private criminal complaints submitted more than five (5) months ago. Lombardi sent several letters requesting a written update on the status of the criminal complaints. Her requests remain unanswered.
In 2001, Paula Lombardi was forced to escrow nearly $23,000 with the Delaware County Office of Judicial Support to appeal an unjust enrichment to Frederick R. Snyder. Lombardi was assured that her funds would remain in an interest bearing account and safeguarded by the court until the dispute of entitlement was resolved.
In March 2012, despite the fact Snyder never paid his debt still owed to Lombardi, the court coerced Lombardi into signing a discharge of the note and lien against Snyder’s New Jersey property for $20,000. The court held NO JURISDICTION to make this determination. What makes this totally unconscionable is that Lombardi had already prevailed in Superior Court on the issue of the New Jersey note and lien. An Order dated July 8th, 2004 was entered in her favor to correct the egregious errors made by the Delaware County Court.

On July 29th, 2005, again Lombardi prevailed when the late Judge Harry Bradley DENIED Snyder’s second [2nd] attempt to remove the lien without payment of his debt for $20,000.
In May 2012, assuming her funds remained in safekeeping with the Delaware County Office of Judicial Support, Lombardi filed a petition to Seek Accounting of her escrow.

On March 18th, 2013, a hearing was finally held. Lombardi discovered her escrow funds were "allegedly” disbursed to Fred Snyder on July 24th, 2009 and March 2nd, 2012. How can escrow funds be disbursed without a valid Court Order? How can an escrow account be distributed while the dispute of entitlement is still ongoing? Why were these alleged disbursements kept secret from Lombardi?
The Delaware County Court has refused to provide Lombardi with proof of the court's "alleged" disbursements to Snyder. Subpoenas were served requesting all bank documents, disbursement orders and canceled checks.
Snyder, the only party in this case, did NOT file objections to the Subpoenas. The Court’s solicitor is NOT a party in this case, yet the court permitted a “non-party” [the solicitor] to submit a motion to “quash” evidence.
Why did the County attorney deliberately violate the Professional Rules of Conduct to Obstruct Justice by filing a motion to "Quash" subpoenas that would produce bank documents and the evidence to prove who received Lombardi’s funds? Why did the Court break the law by granting a “Quash” of the subpoenas when NO Jurisdiction existed?
This case shows that the Delaware County Court can force a litigant to deposit funds into the court, hold the funds for years with NO accounting to the account owner, conceal un-authorized disbursements to unknown parties, provide false information to the court, obstruct civil proceedings to determine what happened to the funds, and finally, refuse to investigate the professional and criminal violations.
The District Attorney has a duty to investigate who is tampering with the records in these proceedings. Who is tampering with the dockets? Who is sending fraudulent “hand-written” documents through the US Mail? Who is desperate to block Lombardi from acquiring bank records?
The people of Delaware County are AT RISK until these violations are investigated and the person[s] responsible prosecuted. How many others have had their property stolen by this court but are afraid to go after the court?
The District Attorney of Delaware County has a duty to investigate the criminal violations and compel the appropriate state authorities to prosecute the person[s] responsible for committing these violations.
“These criminal charges and the actions by this government agency are of public interest.”
